Consent forms for US-based research

Do you have to have the GDPR form if you’re only collecting data from people in the US? I do independent market research as a contractor so it’s impossible for me navigate through all the red tape of GDPR. I like Prolific’s pricing and integration, but if I have to be GDPR compliant, I’ll have to look elsewhere or stick to MTurk.

Dear Will

Welcome to the forum

I am not a lawyer but from reading the GDPR Wikipedia page where it says

the regulation contains provisions and requirements related to the processing of personal data of individuals (formally called data subjects in the GDPR) who are located in the EEA, and applies to any enterprise—regardless of its location and the data subjects’ citizenship or residence—that is processing the personal information of individuals inside the EEA.

It would seem to pertain to individuals inside the European Economic Area and not those in the US.

I am under the impression however that with the right consent form, Prolific can be GDPR conformant.

In my humble non-lawyer opinion.

Tim

Okay, hopefully a simple consent form would work for surveys only collecting data from those in the US.
